JUSTICE MUNGESHWAR SAHOO ORAL ORDER 18-05-2016 It appears that the State of Bihar has wrongly been made party in this writ application. Therefore, the name of State of Bihar is deleted. Heard the learned counsel, Mr. Jitendra Kumar Giri, for the petitioner.
By the order dated 07.04.2015, the learned Addl. District Judge IInd, Saharsa in Title Appeal No.35 of 2009 rejected the application filed by the appellant under Order 41 Rule 27 of the Code of Civil Procedure recording a finding that the documents which are sought to be adduced as additional evidence have got no relation with the issues to be decided in the Appeal.
In view of the above finding of the Court below that the documents are not necessary, this Court cannot interfere with the impugned order in exercise of supervisory jurisdiction.
Thus, this writ application is dismissed.
