1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 385, 504, 506 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent.

4. The informant alleges that he along with his relatives, on four motorcycles, had gone to Ganga Palia on account of land dispute where the accused persons including the petitioners seized all the four motorcycles, but

Patna High Court CR. MISC. No.30550 of 2023(2) dt.27-07-2023 2/3 on intervention of villagers, three motorcycles were returned, but petitioners forcefully kept one motorcycle.

5. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that it is not the case of theft or extortion, rather on account of dispute relating to land, it is alleged that one of the motorcycles was forcefully kept by the petitioners, it is next submitted that no doubt an altercation had taken place on account of dispute relating to land between the side of the petitioners and the informant, but then the motorcycle was not seized and only in order to give a serious colour to the case, petitioners have been roped with false allegation.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

7. Considering the submissions made by the learned counsel for the petitioners, the petitioners abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties
