====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2021 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 304B, 120B/34 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner was the husband of the deceased and onus was upon him to explain the cause of death of the deceased. A report was called for from the court below. It has been reported that uptill now, not a single witness has been examined. It has further been reported that the trial is likely to be concluded within a period of six months.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Patna High Court CR. MISC. No.29526 of 2020(3) dt.03-02-2021 2/2 Considering the nature of accusation, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Sessions Trial No. 315 of 2019 arising out of Deshri (O.P. Sahdei) P.S. Case No. 99 of 2018 is rejected.

The learned trial court is directed to take all necessary steps to conclude the trial preferably, within a period of six months from the date of receipt/production of copy of the order. The District Magistrate and the Superintendent of Police, Vaishali at Hajipur are directed to ensure the production of prosecution witnesses on the date fixed by the trial court, so that the trial could be concluded within the stipulated period of six months.

Let a copy of this order be communicated to the District Magistrate and the Superintendent of Police, Vaishali at Hajipur for needful.
