JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Parasbigha P.S. Case no. 150 of 2016, registered under Sections 341, 323, 324, 325, 307, 504, 506 and 379/34 of the Indian Penal Code. The accusation is that on 15.12.2016 at 12.00 noon the informant along with his family members were cutting paddy crop then petitioner along with Awadhesh Yadav, Ramashray Kumar and Chhotan Yadav having armed with Khanti, pistol and lathi came to the filed and forbade the informant to cut paddy crops. Thereafter, informant told them that he has cultivated the paddy then all of them started abusing to him. At that time, petitioner Rabindra Kumar caused injury through Khanti at the head of Surendra Yadav, uncle of the informant, whereas co-accused Awdesh Yadav caused injury to the butt of the pistol at the head of the informant, when Rubi Kumari and
Patna High Court Cr.Misc. No.55372 of 2017 (2) dt.28-11-2017 2/2 Sonfi Devi, sister and aunt of the informant rushed to save the informant and his uncle then they were also assaulted by Ramashray Yadav and Chhotan Yadav by means of lathi.
Learned counsel for the petitioner submits that, in fact, the occurrence of Marpit took place due to land dispute in which slight injury was caused to the informant, his uncle, aunt and sister and the nature of injuries were simple in nature. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jehanabad in connection with Parasbigha P.S. Case No. 150 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
