Petitioners apprehend arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act and sections 272 and 273 of the IPC .

As per the prosecution case, 17.760 litres of foreign liquor was recovered near the road side.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners and

Learned counsel for the State submits that the petitioners have got criminal antecedent of similar nature. Considering the similar criminal antecedent of the petitioner, prayer for bail of the petitioners is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without being prejudiced by this order.
