JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2018 The petitioner is apprehending his arrest in connection with Rajoun P.S. Case No. 15/2018, registered for offences punishable under Sections 341, 279, 376, 511, 506/34 of the Indian Penal Code.
Allegation against the petitioner is that that he along with co-accused came on motorcycle and dashed the informant and her husband, who were coming on bicycle and petitioner tried to commit rape on the informant.
Submission of learned counsel for the petitioner is that there is delay of 10 days in lodging the F.I.R. It has further been submitted that other co-accused has already granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 25.07.2018 passed in Cr. Misc. No.43754 of 2018.
Patna High Court Cr.Misc. No.47197 of 2018 (2) dt.14-08-2018 2/2 Heard learned A.P.P. also who opposed the prayer for anticipatory bail of the petitioner by stating that the case of the petitioner is different from co-accused Nitish Kumar. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and pray for regular bail, and if any such application is filed the court below shall consider the same on the merit of the case and shall pass an appropriate order.
