The petitioner apprehends his arrest in Sultanganj P.S. Case No. 88 of 2017 registered under Sections 363 and 366A of the Indian Penal Code.
The informant alleged that her daughter was missing from 03.04.2017. The informant, further, alleged that the petitioner, Durgesh Kumar, was stalking her daughter and he might have kidnapped her daughter.
Learned counsel for the petitioner submits that the victim came and made her statement under Section 164 of the Cr.P.C. The victim disclosed her age to be 18 years. The victim did not make any allegation of kidnapping against the petitioner. The victim simply alleged that the petitioner
Patna High Court Cr.Misc. No.56285 of 2017 (2) dt.13-12-2017 2/2 threatened her that he had kept memory card and he can defame her name by uploading her photo on internet. The victim, further, disclosed that she herself went to Danapur and voluntarily solemnized with Suresh Malik.
Considering the facts, aforesaid, the petitioner, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sultanganj P.S. Case No. 88 of 2017 to the satisfaction of the learned A.C.J.M.-IV, Patna City or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
