====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 02-05-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Murliganj P.S. Case No. 275 of 2017, registered for the offences punishable under Sections 341, 324, 307, 379 and 34 of the Indian Penal Code.

Eight accused persons including petitioners descended at the house of the informant and one Bablu Paswan assaulted on the head and above the left eye of the father of the informant by means of Farsa. Santosh Paswan has armed with three-not. While other accused persons are armed with various weapons.

Patna High Court CR. MISC. No.28110 of 2019(2) dt.02-05-2019 2/2 It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. In this case two Bablu Paswan are accused. One is son of late Paras Paswan and another is of Kapildeo Paswan, but informant has not specifically stated as to which Bablu Paswan assaulted his father. Father of informant was assaulted on the head and left eye by means of Farsa but doctor has found only one lacerated wound on left lower eye-lid caused by hard and blunt substance and simple in nature. There is no allegation of assault against petitioner No. 1 and 2. Petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No.275 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) T.Kr.
