The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504 and 34 of the Indian Penal Code. Prosecution case is that while the informant was returning from his sister's husband's house, the accused persons surrounded him abused and assaulted with fists and slaps. The accused persons tore the blouse of the informant's sister. It is also alleged that co-accused Vikash Kumar snatched gold chain while the co-accused Manish Kumar Singh took out Rs.10000/- from the pocket of the informant. It is alleged against this petitioner that he snatched a gold earring from the sister of the informant.
Patna High Court Cr.Misc. No.61583 of 2017(2) dt.20-12-2017 2/2 It is submitted by learned counsel for the petitioner that the petitioner has been roped in as an accused in the present case, since the petitioner is the agnate of the brother-in-law of the informant. The petitioner is also an accused in other case, but he is on bail. Moreover, co-accused Manish Singh and Vikash Singh have been granted regular bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.38362 of 2017.
Considering the nature of accusation in the background of land dispute and accusation being omnibus and general, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Kaimur (Bhabua), in connection with Kudra P.S. Case No. 90 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
