The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Pupri P.S. Case no. 423 of 2021 instituted for the offence under Sections 420, 467, 468, 471 of the Indian Penal Code and Section 12 of Passport Act, 1967. As per allegation in the FIR, petitioner was obtaining passport by submitting fake educational certificates.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. It is also submitted that petitioner

Patna High Court CR. MISC. No.34307 of 2022(2) dt.24-11-2022 2/2 has appeared in the examination and he declared passed in the said examination from NIOS. The mark sheet, Migration-cum-Transfer Certificate, Provisional certificate and Student I.D. card have also been issued to the petitioner by the concerned Board and the same are also available on the website of the concerned Board/ Institution. Learned APP appearing for the State has opposed the prayer of Bail.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned S.D,J,M., Pupri, Sitamarhi in connection with Pupri P.S. Case No. 423 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
