2. Learned counsel for the petitioner is permitted to make necessary correction in paragraph no. 4 of the bail application in course of the day.
3. Earlier the regular bail of the petitioner was rejected vide order dated 13.11.2024 passed in Cr. Misc. No. 58041 of 2024 (Annexure- P2). The present is the second application for regular bail filed on behalf of the petitioner.
4. The petitioner seeks bail in connection with Suryapura P.S. Case No. 246 of 2023, instituted for the offences punishable under Sections 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier, on perusal of the case diary, it transpired that the petitioner has got eight criminal antecedents and having heard rival contentions of both the parties as also the fact regarding recovery of the alleged arms from the possession of the petitioner, this Court was not inclined to grant bail to the petitioner with a direction to the Court below to expedite the trial.
6. After hearing learned counsel for the petitioner, this Court finds that the trial has not yet been concluded. This Court would further take note of the fact that the petitioner is in custody since 03.04.2024. Accordingly, taking into account the aforesaid facts and circumstances of the case and specifically keeping in view the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail after framing of charge, if not already framed on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Suryapura P.S. Case No. 246 of 2023, subject to the following conditions:
(I) One of the bailors shall be own/close member of the family of the petitioner.
Patna High Court CR. MISC. No.29884 of 2025(2) dt.05-05-2025 3/3 (II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
