The petitioner is languishing in custody for the offence punishable under Sections 354(B), 120(B), 420, 504 and 506/34 of the Indian Penal Code.

According to F.I.R., marriage negotiation between the petitioner and the informant was going on, however, informant came to know that the petitioner is accused in a rape case and has connection with the criminals. Thereafter, the informant refused to marry with the petitioner. For that reason, petitioner started putting undue pressure and used to hurl threat to rape the informant and to commit murder of her parents. I have gone through the F.I.R. of Haweli Kharagpur P.S. Case No. 351 of 2017 wherein the allegation against the petitioner is that he ravished to the informant of that case by

Patna High Court CR. MISC. No.29551 of 2020(3) dt.18-01-2021 2/3 persuading her to manage job for her. So far as this case is concerned, the petitioner is in custody since 16.05.2020. Investigation of the case is already complete. Considering the nature of allegation against the petitioner and period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mahila P.S. Case No. 07 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.

(d) with further condition that the petitioner shall file affidavit before the court below at the time of furnishing bail bond that he shall not contact in any mode with the informant or her parents or any of her relatives. If the court below would be informed that the petitioner has repeated identical offence
