JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 24-09-2018 This writ petition has been filed by the petitioner for a direction to the respondents to consider the case of the petitioner for grant of promotion to the post of Routine Clerk. The petitioner was appointed as Peon in the college in question on 15.05.1978 and he was asked to perform the duty and responsibility of the post of Routine Clerk.
Learned counsel for the petitioner, with reference to Annexures 2 and 3, submitted that the case of the petitioner was recommended by the Principal of the College for grant of promotion from the post of Peon to the post of Routine Clerk as the petitioner was performing the work and responsibility of the post of Routine Clerk and as such the petitioner is entitled to consideration of his case for grant of promotion. He further
Patna High Court CWJC No.14628 of 2014 dt.24-09-2018 2/2 submitted that in the absence of grant of promotion the petitioner is entitled for allowance for discharging the responsibility of the post of Routine Clerk.
This writ petition was filed on 26.8.2014 but unfortunately even after more than four years no counter affidavit has been filed.
Under the aforesaid circumstances, the writ petition is disposed of with a direction to the Vice Chancellor of the University to take appropriate decision on the claim of the petitioner for grant of promotion as Routine Clerk and also to consider his case for grant of officiating allowance for discharging higher responsibility. Necessary decision in this regard must be taken by the respondents within a period of six months from the date of receipt/production of a copy of this order. With the aforesaid direction, the writ petition stands disposed of.
