2. Petitioner seeks regular bail in connection with Samastipur Mufassil P.S. Case No. 122 of 2026 registered for the offences punishable under Sections 126(2), 115(2), 137(2), 96, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3. The main submissions advanced by the petitioner's counsel are that the petitioner is innocent and he has falsely been implicated in the present case due to local enmity and misunderstanding and the alleged victim voluntarily left her parental home and was in a consensual love affair with the son of the petitioner namely, Rajkumar Sahni and further, the victim and co-accused Rajkumar Sahni have solemnized marriage out of their own free will and are residing together as husband and wife. Learned counsel further submits that the petitioner is

No.31953 of 2026(2) dt.12-05-2026 2/2 merely the father of the co-accused and has been implicated only on account of such relationship without there being any specific overt act attributed against him. It is lastly submitted that there is no material to show that the petitioner had any active role in the alleged occurrence and the petitioner has clean antecedent and has been languishing in jail since 13.03.2026.
4. Learned APP for the State has opposed the prayer for bail of the petitioner.

In the facts and circumstances of this case, and considering the statements made in the petition as well as the above submissions coupled with this fact that the petitioner is said to be father of the main accused and also taking into account the petitioner's fair and clean antecedent and his custody period, this Court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Samastipur Mufassil P.S.
