The petitioners apprehend their arrest in a case registered for the offence under Sections 302, 201, 34 of the Indian Penal Code.

As per F.I.R., these petitioners, in collusion with other co-accused persons, killed the son of informant and hanged the dead-body on a tree by putting rope in his neck. It is submitted on behalf of petitioners that petitioners are distant relatives of the daughter-in-law of the informant. There is no eye-witness of the occurrence and only on suspicion, they have been made accused in this case. Dead-body of the deceased was actually recovered in the village of informant. Police, after investigation, submitted chargesheet under Section 306 of the I.P.C. Petitioners have got clean antecedent.

Patna High Court CR. MISC. No.29981 of 2022(2) dt.29-09-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar, Sitamarhi in connection with Bela P.S. Case No. 178 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
