2. The petitioners are seeking regular bail in connection with Bishanpur P.S. Case No. 54 of 2023, registered for the offences punishable under Sections 307/506/34 of the Indian Penal Code and Section 27 of the Arms Act, later on Section 302 of the IPC was added.

3. According to FIR, the informant Amit Kumar

Patna High Court CR. MISC. No. 23381 of 2025(3) dt.06-08-2025 2/3 Yadav, along with Mansukh Yadav and Mithilesh Yadav (the deceased), was going by a motorcycle. Mansukh Yadav was sitting behind the informant and the deceased was sitting behind Mansukh Yadav on that motorcycle. According to allegation, coaccused Ajit Yadav fired at the head of Mithilesh Yadav, who died during course of treatment. It has been mentioned in the FIR that the petitioners who are father and son, were making ridges in their field.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Petitioner Satrudhan Yadav @ Shatrudhan Yadav is father of petitioner Mahesh Yadav. He has further submitted that there is no allegation at all against the petitioners. The informant and the second eye-witness, Mansukh Yadav, have stated that the co-accused Ajit Yadav fired at Mithilesh Yadav. Except criminal antecedent, there is nothing against the petitioners.

5. From perusal of the materials available on record, it appears that the allegation of firing is against co-accused Ajit Yadav. The petitioners were making ridges near the place occurrence. Except that, there is nothing against them in the case diary.

Considering the above-mentioned facts and circumstances, let the petitioners above-named, are directed to furnish bail bond and on doing so, the court below shall release the petitioners on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Darbhanga in connection with Bishanpur P.S. Case No. 54 of 2023, subject to the condition that the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
