Learned counsel for the petitioner submits that at the relevant time the writ petition was filed seeking a direction upon the respondents to decide the question of eligibility of the petitioner to receive pension. It is submitted that a decision has been taken by the competent body holding that the service of the petitioner is not pensionable.

Learned counsel for the petitioner submits that in view of the

Patna High Court CWJC No.23522 of 2013 dt.07-12-2015 2/2 aforesaid, he may be permitted to withdraw the application with liberty to assail the order by which the service of the petitioner has been held to be non-pensionable.

Accordingly, as prayed for by the learned counsel for the petitioner, the writ petition stands disposed off as withdrawn with the liberty aforesaid.
