Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Chauri P.S. Case No. 31 of 2020, registered for the offences punishable under Sections 341, 307, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.

The informant is Chowkidar. It is alleged that on 28.04.2020 while he was taking meal at his home at about 20.30 hours, he heard sound of firing and he went to Kali Asthan and saw, FIR named accused persons including this petitioner were firing from one side and Birbal Singh and Paltu Singh from

Patna High Court CR. MISC. No.29337 of 2020(2) dt.09-12-2020 2/2 other side and they were abusing and firing towards each other and when the informant tried to pacify, but they did not agree. It is submitted that petitioner has been falsely implicated in this case. The aforesaid case has been lodged by the local Chowkidar who is having inimical term with the petitioner. No one was hurt in the aforesaid occurrence. Petitioner has got clean antecedent, as stated in para 3 of the petition.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Bhojpur at Ara in connection with Chauri P.S. Case No. 31 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
