The petitioner seeks pre-arrest bail in connection with Sikandra P.S. Case No.21 of 2018 registered under Sections 354, 341, 323, 504 and 506/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that so far as the petitioner is concerned, there is no allegation against him that in any manner he outraged the modesty of the daughter of the informant. It is urged that specific allegation is against co-accused Satish Tanti, who is said to have outraged the modesty of the daughter of the informant.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner. However, he admitted that
Patna High Court Cr.Misc. No.42919 of 2018 (2) dt.19-07-2018 2/2 as far as the petitioner is concerned there is no allegation against him to have misbehaved with the daughter of the informant or any one else.
Considering the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Sikandra P.S. Case No.21 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
