2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 94.5 litres illicit liquor was recovered from co-accused Manish Kumar who disclosed the name of the petitioner.
4. Learned Counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner. Name of the petitioner transpired in this case on the confessional statement of the co-accused Manish Kumar who was apprehended on the spot. Petitioner claims clean antecedent.
5. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.29146 of 2025(2) dt.16-07-2025 2/2 of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Patna City, Patna in connection with Nadi P. S. Case No. 156 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
