The petitioners seek anticipatory bail in connection with Turkauliya P.S.Case No. 566 of 2017, registered for offences punishable under Sections 147, 341, 354, 379, 504 of the Indian Penal Code and Section 3/4 Witch (Dain) Practices Act. Allegation against the petitioners and other accused persons is that they entered into the house of the informant and assaulted the informant with lathi and danda and the petitioners also tried to assault the wife of the informant and administered night soil in her mouth, causing vomiting.
Submission of the learned counsel for the petitioners is that earlier case was lodged by petitioners' side against the
Patna High Court Cr.Misc. No.41494 of 2018 (2) dt.18-07-2018 2/2 informant due to this the present case has been lodged and there is general and omnibus allegation against the petitioners. It is further submitted that some of the accused person has been granted privilege of anticipatory bail vide order dated 05.04.2018 passed in Cr. Misc. No 15602 of 2018.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) each with two sureties of the like amount each in connection with Turkaulia P.S.Case No. 566 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Motihari, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
