2. This is an application for transfer of Matrimonial (Divorce) Case No. 1377 of 2023 from the court of learned Principal Judge, Family Court, Patna to the court of learned Principal Judge, Family Court, Jehanabad.
3. In this case, on 08.08.2024, notice was issued to the Opposite Party and as per the office notes dated 18.09.2024, the sole Opposite Party has already appeared. However, on call there is no representation.
4. The lady has assigned the reasons in paragraphs 10 and 11 of the petition which read as follows:- "10. That it is also stated that her father is working in post office as an agent he is sick person as such father of petitioner is not
Patna High Court MJC No.1406 of 2024(4) dt.19-09-2024 2/2 in a position to move frequently outside Jehanabad.
11. That petitioner being a lady may have to suffer serious hardship and unsafe travelling to Patna from Jehanabad."
5. The contention made in the petition is justified.
6. In that background, M.J.C. No. 1406 of 2024 is allowed. Let the files of Matrimonial (Divorce) Case No. 1377 of 2023 be transferred from the court of learned Principal Judge, Family Court, Patna to the court of learned Principal Judge, Family Court, Jehanabad, with permission to both the parties either to appear physically or through the video conferencing.
