2. The petitioner apprehends arrest in connection with Chhatapur PS. Case No. 140 of 2025 dated 3.5.2025 instituted under Sections 126(2), 115(2), 117(2), 109(1), 351(2), 352 and 3(5) of the BNS.
3. Allegation against the petitioner and other accused persons is that they assaulted the informant variously causing him injuries.
4.Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is submitted that the petitioner is alleged to have assaulted the informant with an iron rod on the head and left
Patna High Court CR. MISC. No.29208 of 2026(2) dt.06-05-2026 2/3 hand causing injuries out of which injury no. 1 is simple and injury no. 2 is grievous. It is further submitted that the petitioner and the informant are cousins and the occurrence took place due to a land dispute. It is also submitted that the police submitted final form on 30.06.2025 by which the petitioner was not sent up for trial; however, the learned Magistrate, differing with the final form, has taken cognizance against the petitioner. It is next submitted that co-accused persons having similar and identical allegations have already been granted bail by a Coordinate Bench of this Court, namely, co-accused Chandan Yadav @ Chandan Kumar, who was granted regular bail vide order dated 11.08.2025 passed in Cr. Misc. No. 48791 of 2025, and co-accused Bhushan Yadav @ Bhushan Kumar Yadav @ Bhushan Kumar, who was granted anticipatory bail vide order dated 31.10.2025 passed in Cr. Misc. No. 66512 of 2025.Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
