This is an application for grant of anticipatory bail in connection with Chakai PS case no. 74 of 2017 registered for the offences punishable under Sections 307 and other sections of Indian Penal Code.
The allegations against the accused persons are assaulting the prosecution side resulting in grievous injuries on the person of the informant and his father.
The learned counsel for the petitioners submits that though there is allegation of one assault committed as against the petitioners herein, the victim has suffered multiple injuries, hence injury report does not support the version of the informant.
Patna High Court Cr.Misc. No.61080 of 2017 (3) dt.12-01-2018 Having regard to the facts and circumstances of the case, more particularly the fact that several injuries have been inflicted on the victim, I am not inclined to grant anticipatory bail to the petitioners.
Accordingly, the prayer for anticipatory bail of the petitioners stands rejected however, the petitioners may surrender before the court below and pray for regular bail and the court below will decide the case on the same day keeping in view the fact that the injury report does not support the version of the informant.
