The petitioners seek pre-arrest bail in connection with Bhagwanpur P.S. Case No.222 of 2016 registered under Sections 302, 120B read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

Keeping in mind the allegation of active participation of the petitioners in the alleged murder of son of the informant as also the fact that though the other accused persons have appeared and faced trial, the petitioners are evading arrest, I am not inclined to grant them pre-arrest bail. Accordingly, their application for grant of pre-arrest bail is rejected.
