JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-02-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Bochahan PS case no. 79 of 2016 registered for the offences punishable under Sections 364, 365 & 34 of the Indian Penal Code.

After some arguments, the learned counsel for the petitioner prays for withdrawal of the present anticipatory bail petition with a liberty to approach the learned trial court for grant of regular bail.

Accordingly, it is directed that in case the petitioner surrenders before the court concerned in connection with Bochahan P.S. Case No. 79 of 2016 within a period of four weeks

Patna High Court Cr.Misc. No.57395 of 2017 (3) dt.19-02-2018 2/2 from today, the learned trial court would consider and dispose of the prayer of the petitioner for grant of regular bail on the same day by a reasoned and speaking order, considering the fact that the petitioner is the Bhaisur of the victim lady as also the fact that the petitioner was at Delhi at the time of occurrence and he was undergoing treatment for the disease of tuberculosis. The petition is disposed of as withdrawn.
