Heard the parties.

The petitioner is languishing in custody for the offence punishable under Section 304(B)/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. Petitioner is in custody since 04.06.2018. Earlier prayer for bail was refused on 06.11.2018.

Learned counsel for the petitioner submits that even the trial has not been committed to the court of sessions and there is no chance of early conclusion of the trial. Petitioner is ready to cooperate with the trial.

No.29451 of 2020(2) dt.09-11-2020 2/2 Considering the entire facts aforesaid and the fact that there is no reason for further detention of the petitioner as under trial prisoner in absence of any material to substantiate that the petitioner is likely to tamper with the evidence or abuse the privilege of bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chauk P.S. Case No. 372 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
