2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 127(2), 75 of the Bharatiya Nyaya Sanhita Act and Sections 3, 4, 5 and 7 of the Immoral Trafficking Act.
3. As per prosecution case, on secret information that sexual activities were carried out, a raid was conducted and boys and girls were found in objectionable condition in the cabin of Plan B Restaurant. This petitioner is alleged to be cook of the alleged restaurant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.28250 of 2025(2) dt.16-05-2025 2/2 case only because he is cook of the restaurant. Petitioner has no concern with the alleged occurrence. Further submission is that similarly situated co-accused Rupesh Ray @ Rupesh Kumar Ray has already been granted bail by a Co-ordinate Bench of this Court vide order dated 07.03.2025 passed in Cr. Misc. No. 11167 of 2025. Petitioner has got clean antecedent. Petitioner is in custody since 11.12.2024.
5. Learned counsel for the State opposes the bail petition.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Bhagalpur in connection with Habibpur P.S. Case No. 243/2024.
