Petitioner is husband of Opposite Party No.2. There is series of matrimonial cases between the parties. Even Opposite Party No.2 is accused in a criminal case brought by the mother of the petitioner. Opposite Party No.2 has also filed a case for divorce as well as a case for maintenance against the petitioner.
There is specific allegation against the petitioner of demand of dowry and torture for the same including physical assault.
The petitioner has challenged the order of cognizance dated 28.07.2017 passed in Complaint Case No.1317 of 2016 whereby the learned Sub-Divisional Judicial Magistrate, East Muzaffarpur has asked the petitioner to face trial for offences
Patna High Court CR. MISC. No.406 of 2018(4) dt.17-09-2019 2/2 under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
There is sufficient material disclosing ingredients of offences against the petitioner. Hence, the impugned order requires no interference in exercise of this jurisdiction under Section 482 Cr.P.C. Accordingly, the application stands dismissed as devoid of any merit.
