The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the police recovered 205.4 litres of liquor said to have been kept by the accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He has no concern with the allegedly seized liquor. He is in custody since 25.10.2020 and chargesheet has been submitted in the case.

No.39637 of 2021(3) dt.25-01-2022 2/2 The application for bail is opposed by learned APP for the State who submits that the petitioner has an antecedent under the Bihar Prohibition and Excise Act, 2016. Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Special Case no. 2767 of 2020 (arising out of Kankarbag P.S. Case no. 242 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
