====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 07-11-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner is apprehending his arrest in connection with K. Nagar P.S Case No. 308/2024 dated 13.11.2024 registered for the offence punishable u/s 143(2), 137(2) and 62(2) of the B.N.S. and Sections 75, 80 and 81 of the J.J. Act.
3. As per the prosecution case, the informant, District Coordinator in N.G.O., having knowledge of illegal traffacking of child by one Ankit Kumar who made a deal of Rs. 1,05,000/- for providing a child. The amount was handed over by the District Child Welfare. They moved with Ankit Kumar. Later, Ankit Kumar made one Sangita Rani to sit in the car, they
Patna High Court CR. MISC. No.30926 of 2025(3) dt.07-11-2025 2/3 reached Dumka, then Srinagar Bale Road where the lady disappeared and later came with an infant. As the local police was informed, an exchange of child/money took place, the police caught them which followed the FIR.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The petitioner is a lady. The petitioner is Asha worker. The petitioner is not in touch or is having any relation with the co-accused, Sangita Kumar. The petitioner at no point of time ever told Sangita Kumar that she will manage/arrange child for sell. It is further submitted that no one has seen the petitioner kidnapping the child and no any complaint has been lodged against him from the missing child's parents, hence no case is made out against the petitioner under any section of the Juvenile Justice Act. The other co-accused person has already been granted regular bail by this court vide order dated 17.03.2025 passed in Cr. Misc. No. 7819/2025. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.30926 of 2025(3) dt.07-11-2025 3/3 of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Purnea in connection with K. Nagar P.S Case No. 308/2024, subject to conditions as laid down under section 482(2) of the B.N.S.S.
7. The application stands allowed.
