JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Jehanabad Mahila P.S.Case No. 81 of 2016, registered for offences punishable under Sections 341, 323, 376, 504, 506/34 of the Indian Penal Code and Section 4 of the POCSO Act. The allegation against the co-accused, Amarjeet Paswan is of committing rape upon the informant and upon getting information, when the father and mother of the victim girl went to the house of the co-accused, the petitioners and other co-accused assaulted them.
Submission of the learned counsel for the petitioners is that the petitioners have been falsely implicated and the petitioners being unmarried sister and mother of the co-accused,
Patna High Court Cr.Misc. No.41507 of 2018 (2) dt.18-07-2018 2/2 Amarjeet Paswan, who allegedly committed rape upon the informant, are made accused only for the purpose of putting pressure upon the family members of co-accused, Amarjeet Paswan. It is further submitted that the petitioners have no criminal antecedents.
Learned A.P.P. opposes the prayer for.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender before the court below within a period of six weeks from the date of the order, he will be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Jehanabad in connection with Jehanabad Mahila P.S.Case No. 81 of 2016, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
