The petitioners apprehend their arrest in connection with Motipur P.S. Case No. 924 of 2018 registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code.

The present case has lodged by the informant Vinod Kumar against these petitioners and others. The informant has alleged that he found the dead body of his father hanging in the Lichi Orchard with a Lichi branch and his leg was touching with the earth and blood was oozing out from his nose and mouth and Kurta was also torn. He has also alleged that due to land dispute, his uncle Ramanand Sahni and these two petitioners were

Patna High Court CR. MISC. No.28133 of 2019(5) dt.24-07-2019 2/2 threatening to kill him for three days. They have committed murder of his father under hatching conspiracy and hanged him. Learned counsel for the petitioners submitted that the petitioners are innocent and have committed no offence. The entire allegation against the petitioners is false and fabricated. No offence is made out against the petitioners. However, the petitioners are the Pattidar and the informant has made all the family members as accused having considered the record of the case diary. No specific allegation against these petitioners.

In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Juduicial Magistrate (West), Muzaffarpur, in connection with Motipur P.S. Case No. 924 of 2018, G.R. No. 3667 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
