JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State through video conferencing.

The petitioner apprehends arrest in a case registered for the offence punishable under sections 366A,504,506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the victim Chanda Kumari, in her section 164 Cr.P.C. statement (Annexure 2), has stated that it was her elder sister Rukmini who forcibly married her to one Govind Kumar, who happens to be Dewar of Rukmini. The victim has further stated that she desires to go with her husband to Sasural. Thus, she has not made any allegation against this petitioner. The Medical Board

Patna High Court CR. MISC. No.29221 of 2020(2) dt.04-12-2020 2/2 vide its report dated 7.8.2019 has assessed her age in between 16 to 17 years. Learned counsel further submits that the petitioner is cousin brother of said Govind Kumar. Petitioner has got no criminal antecedent.

In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Lakhisarai in Medani Chauki Police Station Case No. 65/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
