The petitioner is apprehending his arrest in connection with Atri P.S. Case No. 6 of 2018, registered for the offences punishable under Sections 341, 354, 376, 511, 506 of the Indian Penal Code and Section 8/2 of the POCSO Act.

Allegation against the petitioner is that he entered inside the house and attempted to commit rape on the minor girl and it is a case of POCSO Act.

Submission of learned counsel for the petitioner is that false case has been lodged against the petitioner after nine days of the occurrence. The petitioner was brutally assaulted and then the case was lodged.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.41823 of 2018 (2) dt.20-07-2018 2/2 Having heard both sides and in view of the allegation of rape upon a minor girl, as stated above, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected.
