2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 12(2), 115(20, 118(1), 109 and 3(5) of the BNS.
3. The case of the prosecution is that the petitioner along with others assaulted the son of the informant with knife. Specific allegation against this petitioner is that he has given a knife blow on the stomach of Informant's son.
4. Learned counsel for the petitioner submits that in this case the nature of injury is simple. It has also been submitted that the learned Co-ordinate Bench has granted bail to Vishal Kumar who was having allegation of assaulting on neck of with knife vide Cr.Misc. Case No. 19516 of 2025. The case of this petitioner
Patna High Court CR. MISC. No.29259 of 2025(2) dt.19-05-2025 2/2 stands on better footing. The petitioner is in custody since 02.01.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bairgania P.S. Case No. 226 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi.
