====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. He submits that there is no recovery from the conscious possession of the petitioner rather 1174.68 litres of illegal liquor is said to have been recovered from the pick-up van which is not belonged to the petitioner. He submits that the name of the petitioner has come in this case on the basis of the suspicion.

Learned APP for the State opposed the prayer for bail.

In the facts and circumstances of the case, the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJII-cum-Special Judge, Excise Act, Sitamarhi in connection with G.O. Case No. 12 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

The bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of Rs.20000.00 (Rupees Twenty Thousand) in the PM Cares Fund. devendra/- (Anjani Kumar Sharan, J) U T
