This is the second attempt of the petitioner having failed earlier.

The petitioner apprehend his arrest in connection with Udwantnagar P.S. Case No. 166 of 2022 for the offence registered under Sections 147, 149, 341, 323, 307, 379, 504, 506, 337 and 338 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution story, the allegation is that the petitioners herein, after threatening the informant as to why he has purchased the land assaulted him. The allegation against Ram Ishwar Singh is of assaulting with lathi, Amit Kumar threw stone while Suman Kumar Singh (petitioner herein) firstly

Patna High Court CR. MISC. No.31420 of 2023(2) dt.17-05-2023 2/2 assaulted with rod and thereafter assaulted his nephew on the leg and the last allegation against him is of opening fire from a country made revolver which however, did not hit the informant.

Earlier prayer for bail of the petitioner was rejected vide an order dated 04.02.2023 passed in Cr. Misc. No. 65272 of 2022.

It is unfortunate that despite an appropriate order passed rejecting his anticipatory bail application, once again the petitioner has chosen to prefer anticipatory bail. The same is accordingly, dismissed with a cost of Rs. 10,000/- to be deposited to the Patna High Court, Legal Services Committee. The cost is to be deposited within a period of two weeks from today and the receipt will be submitted before the Court concerned.
