JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25(1-b), 26(i)(ii) of the Arms Act.

Two country made kattas and cartridges were recovered beneath the bed of the petitioner when police raided his house.

Submission on behalf of the petitioner is that the present case was lodged at the instance of enemy of the petitioner and as a matter of fact, the aforesaid recovery was made in absence of the petitioner.

Considering the aforesaid facts and circumstances as
