The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Excise Prohibition Act, 2016.

Learned counsel for the petitioner has submitted that there is no recovery from the conscious possession of the petitioner. The recovery is from the outside of the house. The petitioner has no criminal antecedent.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory

Patna High Court CR. MISC. No.30696 of 2019(3) dt.21-08-2019 2/2 bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Complaint Case No. C2/644/2018 to the satisfaction of the learned A.D.J. 2nd-cum Special Judge, Sitamarhi, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
