The petitioner apprehends his arrest in a case registered for the offence under Section 304(B)/34 of the Indian Penal Code.

It is a case of 'Dowry Death'. The petitioner alongwith others are alleged to have committed the murder of niece of informant due to non-fulfillment of demand of dowry. Petitioner is husband of the deceased.

It is submitted on behalf of petitioner that petitioner is innocent and has been falsely implicated in this case. There is general and omnibus allegation and at the relevant time, petitioner was not present at the place of occurrence, rather he was at his working place at Bangalore. In support of the same, he has annexed monthly duty chart, which is at Annexure - 3.

No.32597 of 2022(2) dt.10-10-2022 2/2 However, learned A.P.P. for the State opposed the prayer for anticipatory bailand submitted that petitioner is husband of deceased and there is specific and direct allegation of demand of dowry against him. Deceased has died within seven years of her marriage at her matrimonial house. Considering the nature and gravity of offence and the fact that petitioner is husband of the deceased, the prayer for anticipatory bail of petitioner is rejected.
