Petitioners apprehend arrest in a case registered for the offence punishable under Sections 272/273/308/34 of the Indian Penal Code and section 30a of the Bihar Prohibition and Excise Act.

Total 34 liters of toddy and foreigh liquor were recovered from a place near Jamo canal. Some of the accused persons were apprehended on the spot while petitioners and others managed to flee away at the time of making raid. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been

Patna High Court CR. MISC. No.29144 of 2020(2) dt.04-12-2020 2/2 implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners. Petitioners are no way concerned with the alleged recovery. Considering the facts of the case, in the event of arrest/surrender, let both the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act Siwan in Jamo Bazar Police Station Case No. 87/2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
