The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No. 283 of 2022 for the offence registered under Section 363, 366 (A) of the I.P.C and Section 8 of the POCSO Act.
As per prosecution case, the daughter and niece of the informant enticed away by the petitioner and other co-accused persons.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case only on the basis of suspicion. The petitioner works at Surat and the victim girl herself gone to Surat. He further
Patna High Court CR. MISC. No.30735 of 2023(2) dt.14-06-2023 2/2 submits that in her statement recorded under Section 164 Cr. P.C., the victim stated that she herself gone to Surat and she did not leveled any allegation of overt act against the petitioner. Petitioner has no criminal antecedent and he is in jail custody since 02.01.2023.
Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Court (POCSO Act)- cum- 6th Additional Sessions Judge, Begusarai in Bhagwanpur P.S. Case No. 283 of 2022. (Sunil Dutta Mishra, J) khushbu/- U T
