The petitioner apprehends his arrest in a case registered for the offence under Section 379 of the Indian Penal Code.

As per F.I.R., it is alleged that petitioner and others were cutting 10 popular trees, 10 green berry trees, 2 green palm trees and were also filling soil.

It is submitted on behalf of petitioner that petitioner is simply a victim of false implication due to suspicion. From bare perusal of F.I.R., it is apparent that informant is not eye-witness of the occurrence, rather she came to know about the alleged occurrence from others. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.32582 of 2022(2) dt.10-10-2022 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Turkauliya (Banjariya) P.S. Case No. 117 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
