JUSTICE BIRENDRA KUMAR ORAL ORDER 31-07-2019 The report of the learned Trial Judge would reveal that even charges have not been framed in the case because another co-accused Uttam Singh was not produced from the jail at Malda (West Bengal) and remaining three accused persons who are on bail have not appeared before the court and coercive step have been taken against them for procuring their attendance. Earlier prayer for bail of the petitioner was rejected on 30.07.2018 in Cr. Misc. No. 13460 of 2018 on merit. Considering the nature of allegation against the petitioner disclosed in order dated 30.07.2018 as well as the circumstances under which trial is not taking any progress, I am not inclined to enlarged the petitioner on bail. Hence, prayer for bail stands rejected.
