The petitioner seeks bail in connection with Kharik P.S. Case No. 190 of 2019 for the offence under Sections 414, 419, 420/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 19935 of 2020 and the case of this petitioner stands of similar footing. The petitioner is rotting in judicial custody since 02.05.2020. Hence, the petitioner may be enlarged on

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-2nd, Naugachia, Bhagalpur in connection with Kharik P.S. Case No. 190 of 2019 subject to the conditions;- (I) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in their event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below. (ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
