The petitioner seeks anticipatory bail in connection with Sahebganj P.S. Case No.324 of 2017, registered for offences punishable under Sections 406 and 420/34 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner, who happens to be Panchayat Sewak, is of defalcation of huge amount which was paid for the purpose of distribution under Social Security Pension Scheme.
Submission of the learned counsel for the petitioner is that due to misconception of the Block Development Officer, Sahebganj, the case had been lodged against the petitioner. It is further submitted that informant was himself issued a certificate to the effect that the petitioner had already submitted vouchers of the Scheme and the petitioner has been falsely implicated in
Patna High Court Cr.Misc. No.42768 of 2018(2) dt.24-07-2018 2/2 this case.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Sahebganj P.S. Case No.324 of 2017, G.R. No. 2778 of 2017 to the satisfaction of learned Sub Judge 1st -cum- A.C.J.M., West Muzaffarpur, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
