2. The petitioners are named in the F.I.R. and apprehending their arrest in connection with Bagaha P.S. Case No. 70 of 2026 registered for the offences punishable under Sections 126(2), 115(2), 109(1), 303(2), 329(4), 74, 352, 3(5) of BNS.
3. The allegation against petitioners is to assault informant and her family members during the occurrence causing head and bodily injuries.
4. It is submitted by learned counsel appearing
Patna High Court CR. MISC. No.34210 of 2026(3) dt.21-07-2026 2/3 on behalf of the petitioners that occurrence took place due to neighborhood petty issues, while informant was pouring water to her newly constructed wall of her house. Petitioner no. 3 is own brother of the husband of the informant and petitioner no. 1 and 2 are son of petitioner no. 3. It is submitted that upon medical examination nature of injury was found simple in nature and thus by negating intention to cause death of the informant/ injured.
5. Explaining criminal antecedent, it is submitted that petitioner no. 2 is a man of clean antecedent, where petitioner no. 1 and 3 was earlier found involved in one more criminal case of similar nature of year 2013, in which after facing trial, they were acquitted, therefore, their criminal antecedent is also fair.
6. Learned APP opposes the prayer of bail.
7. In view of aforesaid factual submission and by taking note of fact as injury upon medical

No.34210 of 2026(3) dt.21-07-2026 3/3 examination of the injured found simple in nature primafacie negating intention to cause death, accordingly all above-named petitioners, in the event of their arrest or surrender before the court below, within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Bagaha, West Champaran /concerned Court, where the case is pending in connection with Bagaha P.S. Case No. 70 of 2026, subject to the conditions as laid down under Section 482(2) of BNSS.
