The petitioner seeks bail in Complaint Case No. 488/2013, instituted for offences under Section(s) 323, 498(A), 379 and 504 of the Indian Penal Code read with Section 3⁄4 of D.P. Act.
The complainant has alleged in the complaint that her marriage was performed with this petitioner in the year 2010. After marriage she was tortured in her Sasural for demand of one she-buffalo and cash of Rs. 25,000/-. She was ousted from her matrimonial house.
The petitioner was earlier granted provisional
Patna High Court CR. MISC. No.29152 of 2019(2) dt.02-05-2019 2/3 anticipatory bail, which was not confirmed by the court below and non-bailable warrant was issued on 20.03.2017, against the petitioner.
Learned counsel for the petitioner has submitted that petitioner is always ready to keep the complainant for which he has tried his best after grant of anticipatory bail but the complainant does not want to live with this petitioner. Petitioner is in custody since 01.03.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jhanjharpur, Madhubani, in connection with Complaint Case No. 488/2013, subject to the conditions that (I) both the bailors shall be the close relative of the petitioner.
(II) Petitioner shall be present on each and every date fixed by the court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioner and
Patna High Court CR. MISC. No.29152 of 2019(2) dt.02-05-2019 3/3 (III) if petitioner tamper with the evidence in the case, prosecution will be at liberty to move for cancellation of bail bond of the petitioner.
