The petitioner seeks bail in a case registered under Sections 304B/34 of the Indian Penal Code.

Allegation against the petitioner is of committing torture and caused death of the victim due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 30-06-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. From perusal of paragraphs-28, 29 & 30 of the case diary, it is evident that the deceased was

Patna High Court CR. MISC. No.29581 of 2019(4) dt.18-06-2019 2/2 suffering from prolonged illness and due to the said reason, in course of treatment, she died. No offence u/S 304B of the Indian Penal Code is made out.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra in connection with Isuapur P.S. Case No. 87 of 2018.
